Dear Commission,

I am sending this request for investigation regarding the handling of my chapter 13 bankruptcy by Atty George E. Jacobs of Flint.

He has continually been negligent, and has failed to represent me properly.

I am also registering a complaint with the United States Department of Justice, Trustee Division. I believe that my case has been deliberately mishandled by them in order to keep my hard earned money flowing into their pockets.

In 1997, he ignored my numerous attempts to contact him in an attempt to pay off the vehicle in my chapter 13 plan. My Mother was going to pay the car off for me. He never responded and would never return my calls.

Now the trustee’s office is telling me that it will take another 29 months to pay off the balance of 164.22 on the vehicle!

The attorney’s office never forwarded a requested proof of insurance to the lein holder on the vehicle, even though I provided it to them immediately upon request. This resulted in the credit union filing a motion to reposess the vehicle, and a court hearing had to be scheduled to protest. This would not have been necessary had the proof of insurance been forwarded to them when I provided it.

George E. Jacobs has caused my bankruptcy to go into a two year extension by not filing proper forms with the trustee’s office, and never reporting the reductions in my mortgage payments to them. I always provided documentation from the mortgage company promptly to his office, as well as the trustee.

He lied and said that they were lost, or never made it into my file.
You will find attached documentation from the trustee’s office that they have my mortgage payment set at 1,875.94.

It was actually lowered in March of 2009 to 1,605.32, and in October of 2009 to 1,520.30. You will see in the attached email correspondence between me and Barb Foley from the Flint Trustees Office that their office has been aware of my decreased mortgage payments, and readily admit that, yet she admonishes me for questioning their re-payment plan because it is underfunded with a mortgage payment of 1,875.94 per month!

The trustee and my attorney presented an extension plan to the court with this false amount, knowing what the result would be.

There was a mortgage arrears of 4,751.64 at the beginning of the bankruptcy period. The trustee has not been able to account for paying any of that, even though my mortgage has been overpaid by an estimate of at least 7,000.00 in 2009.

In 2008, Mr. Jacobs said that he would turn in the necessary paperwork for me to modify my loan. I was under the impression that I could not deal directly with the mortgage company. He never forwarded the completed loan modification package to them when I filled it out in October of 2009 and gave it to him, but lied to me that he did. I have confirmed with them that they never received it, and never had any contact with Mr. Jacobs’ office after September of 2009.

I have requested a full audit by the mortgage company, and am waiting for the results of that. They are also sending a new modification application through the attorney’s office, and I can fax that directly to them this time when I complete it.

George E. Jacobs has also blatantly lied to me regarding the results of hearings on my case, as you will see proven in the documentation that I have provided.

I hope that the commission can take some kind of disciplinary action in the gross mishandling of my case by George E. Jacobs.

In his last correspondence with me, George Jacobs is inviting me to get a different attorney. I feel that he should provide the service that he was paid for in the beginning. I am worried that he will stop doing his job altogether now that I have filed this grievance. Can he legally do that? Isn’t he bound to represent me unless I release him? I cannot afford another 3,500.00 attorney fee.
